Nokia Limited Warranty for Nokia digital health Products is a commercial manufacturer’s warranty provided by Nokia Health USA Inc. (“Nokia”) and is applicable in United States of America and Canada. Rights attached to this warranty are distinct to the rights provided by applicable consumer law and this warranty shall be construed as in addition to, and not instead of, rights granted by applicable consumer law.
Nokia Limited Warranty for Nokia digital health Products (the “Warranty”) is valid only in the countries where Nokia digital health Products are sold by Nokia through its website, irrespective if the Products are purchased from the webstore allowing the purchase of Nokia digital health Products or through retailers in such countries.
This Warranty covers any Nokia branded digital health product (“Product”), available for sale on Nokia webstore allowing the purchase of the Products, against defects in materials or workmanship, when used fully in accordance with Nokia digital health’s published guidelines attached to each Product.
This Warranty does not cover:
Any use of the Product that does not comply with the expected use of the Product;
Any use of the Product that is not supported and explicitly permitted in Nokia’s published guidelines attached to the Product;
Damage caused by accident, abuse, misuse, corrosion flood, fire, earthquake or other external causes;
Natural wear and tear;
The lifetime of the battery;
Accessories and consumable components (such as bracelets, batteries, chargers, cables) unless they are the main subject of the order;
Cosmetic damage, including scratches;
Damage caused by use with another product;
The fact that the use of the Nokia digital health Product and services will be uninterrupted or error-free.
Nokia is not responsible for damage arising from failure to follow instructions relating to the Product’s use.
Nokia Limited Warranty for Nokia digital health Products does not cover any contact with liquid for Products that are not expressly designated as « waterproof »
Nokia Limited Warranty for Nokia digital health Products runs for ONE (1) YEAR from the date you initially purchased the Product.
You may contact our customer support department and fill out the requested information. We may require that you provide proof of your original retail purchase.
If your Product is covered by Nokia Limited Warranty for Nokia digital health Products, we will provide you with a free replacement Product and we will bear the cost of (1) returning the Product and (2) shipping of the replacement Product. The replacement Product may be a refurbished product. The replacement Product will be sent to you after reception of the Product under warranty.
The replacement Product is warranted for the remainder of the original Product’s warranty period or for an additional 90 days starting from the Delivery date of the replacement Product, whichever is longer.
Such replacement may have an impact on information stored in the Product. Such information may be lost or altered. It is your responsibility to backup any data, software, or other materials you have stored in the Product.
However, in the case that we or our subcontractors conclude, after checking the returned Product that the warranty provided under these terms does not apply due to any exclusion provision, we may nevertheless be able to provide you with the following choice:
We send a Product back to you at your own expense and risk after payment of all return shipping and handling expenses.
Destruction of the Product. This solution will be automatically chosen if you refuse to pay the returning expenses within 14 days from the day we notified you of the fact that the Product is not covered by Nokia Limited Warranty for Nokia digital health Products
This Warranty gives you specific legal rights, and you may also have other rights which vary from State to State.
Rights attached to this warranty are distinct to the rights provided by applicable consumer law and this warranty shall be construed as in addition to, and not instead of, rights granted by applicable consumer law.
EXCEPT AS PROVIDED IN THIS WARRANTY AND TO THE MAXIMUM EXTENT PERMITTED BY LAW, NOKIA IS NOT LIABLE FOR ANY DIRECT, INDIRECT (SUCH AS LOSS OF USE, LOSS OF REVENUE, LOSS OF OPPORTUNITY, LOSS OF REPUTATION), SPECIAL, OR CONSEQUENTIAL DAMAGES RESULTING FROM ANY BREACH OF NOKIA LIMITED WARRANTY FOR NOKIA DIGITAL HEALTH PRODUCTS OR FROM ANY MISUSE OF THE PRODUCT. THIS LIMITATION OF LIABILITY SHALL NOT APPLY TO PERSONAL INJURY, TO THE EXTENT SUCH LIMITATION IS NOT PERMITTED BY LAW.
